How could this rectangle be correct?

I solved an "annoying" puzzle today and am surprised that the rectangle marked in red is there.
This sudoku puzzle has two solutions which should not be possible. Or?
Where am I thinking wrong?

R34C12 meets most of the criteri for being a deadly rectangle, however R4C12 are both clues, which prevents this from forming a deadly pattern. As you are not allowed to change clues, the digits can not be swapped.
